The short version
You're an independent business. You set your prices, decide which jobs to accept, and do the work with your own trucks and people. Towhub brings you customers, collects the customer's payment, keeps a platform fee (12% on marketplace jobs, 4% on customers you bring, 10% on business-account jobs), and pays you out weekly through Stripe. You must stay licensed and insured, and you must not take a Towhub customer off-platform to avoid the fee.
This Agreement is between Towhub and the tow company ("Provider", "you") that lists on Towhub. The person accepting it confirms they're authorized to bind the company. It supplements the Terms of Service.
1. Independent business
You are an independent contractor and operator. Nothing here creates an employment, agency, joint venture or franchise relationship. You control your trucks, crew, hours, routes, and how each job is performed. Your drivers and staff are yours; you are responsible for their pay, taxes, licensing, conduct and safety.
2. Eligibility and compliance
To receive offers in a region you must have on file with Towhub, and keep current:
- Washington: registration as a tow truck operator with the Washington State Patrol (RCW 46.55), any city or county tow licenses that apply where you operate, and proof of the insurance WSP requires (liability, cargo/on-hook, and garage-keepers). Oregon and California requirements apply when those regions open.
- A current business registration and, where applicable, a state tax registration (towing is subject to sales tax in Washington; you are responsible for collecting and remitting what the law requires — Towhub itemizes tax on receipts using the rate for the pickup location).
- Trucks and drivers that meet the licensing, inspection and safety rules that apply to them.
We verify documents before approval and may re-verify at any time. Expired or lapsed documents pause offers automatically. You must tell us within 24 hours if a license, registration or policy is suspended, cancelled or materially changed.
3. Listing, pricing and quotes
- You set your prices in Towhub (hook-up, per-mile, minimums, included miles, after-hours multiplier, extras, flat prices for roadside services). Quotes to customers are computed from your rates and the request; Towhub does not set or adjust your prices.
- A quote you're offered is your offer to do the job at that price. When a customer picks it, you accept or decline within the offer window. Accepting creates a binding job at the quoted price plus any extras the customer approves.
- Extras (winching, dollies, changed destination) must be proposed and approved in the app before they're performed to be charged. Extras added afterward may be refused.
- You may pause offers at any time ("Accepting jobs" off). Reliability: cancelling after you've accepted, for a reason within your control (crew or truck unavailable, took another job, distance), is recorded as a strike. Three strikes in 30 days pause new offers for 24 hours automatically; repeated patterns may lead to suspension. Cancellations because the customer was unreachable, gave wrong information, asked you to cancel, or the job was unsafe are recorded but don't count.
- Late cancellations by customers: once your driver is en route, a customer who cancels is charged your en-route dispatch fee (set on your Pricing page); once on scene, your hook-up fee. Towhub collects it from the customer's hold and pays it out like a job, less the platform fee. Cancellations you initiate never charge the customer.
4. Doing the job
- Arrive when you said you would. If you'll be late, update the status; the customer sees your ETA.
- Drivers must keep the job's status current (en route, on scene, loaded, in transit, delivered, complete) and share location while on a job. Status and location are shown to the customer and form the job record.
- Treat customers and their vehicles with care. Take pickup and delivery photos when condition matters. Get a signature at release when you can.
- Don't ask the customer to pay you directly for a Towhub job, and don't move a customer who came through Towhub to an off-platform transaction for the same job.
- Comply with all laws that apply to the job, including private property impound rules, notice requirements, and storage-rate regulations where you operate.
5. Fees and payouts
- Platform fee: 12% of the job price (before tax) on marketplace jobs; 4% on bring-your-own jobs you enter for your own phone customers; 10% on jobs from business accounts. Fees may differ by plan; the current fee is shown on every quote and in your settings.
- Towhub collects the customer's payment through Stripe as your payment agent. Your net (price − fee) plus collected tax is transferred to your Stripe Connect account; Stripe pays out on its standard schedule (typically weekly). You're responsible for keeping your Stripe account and bank details current.
- Business-account jobs billed on invoice are paid to you when the business pays Towhub, or on the terms shown for that account. [DECISION: whether Towhub advances net-30 payouts.]
- Refunds and disputes: a customer may open a dispute within 30 days of a job. You'll be notified and have 48 hours to respond in the app; if you don't, we decide on the record. When Towhub refunds a customer because of a job's performance, the refunded amount (including the fee share) is reversed from your Stripe balance or deducted from future payouts. You'll see the job record we relied on, and an upheld no-show or complaint may count as a reliability strike.
- Taxes on your income, and sales tax remittance, are your responsibility. Towhub provides the reports.
6. Ops tools and data
- Towhub's tools (dispatch, crew, timecards, fleet, impound, customers, exports) are provided for your business use. Data you enter — customers, vehicles, staff, trucks, notes, photos — is yours. Towhub processes it to provide the Service and may use aggregated, de-identified data to improve the Service.
- Personal information you receive about Towhub customers may be used only to perform the job and for records the law requires. Don't market to Towhub customers using information from a Towhub job.
- You're responsible for the accuracy of timecard, pay-rule and inspection data and for how you use it with your employees. Towhub's overtime calculations follow published state rules but are not legal or payroll advice.
- Plan limits (seats, trucks, locations) and any subscription fees are shown on the Plan page and may change with notice.
7. Brand and reviews
You may use the Towhub name and marks to say you're on Towhub, in the forms we provide. We may show your company name, logo, ratings, and reviews (including reviews you import from Google, labelled as such) on the Service.
8. Insurance and indemnity
You maintain the insurance required by law and, in any case, commercial auto liability, on-hook/cargo, and garage-keepers coverage adequate for the vehicles you tow and store. You'll indemnify and hold Towhub harmless from claims arising from your performance of jobs, your vehicles and staff, your violation of law, or your breach of this Agreement, except to the extent caused by Towhub's own negligence. 9. Suspension and termination
Either party may end this Agreement at any time. Towhub may suspend or remove a Provider for lapsed compliance, customer complaints, safety concerns, fraud, off-platform diversion, or breach. Jobs already accepted must still be completed or properly cancelled. Payouts owed for completed jobs are paid subject to Section 5.
10. Limitation of liability
Towhub is not liable for lost profits, lost jobs, or indirect or consequential damages, and its total liability to you is limited to the platform fees you paid in the 12 months before the claim, to the extent permitted by law.
11. General
Washington law governs; venue is King County, Washington. This Agreement, the Terms of Service and the policies they reference are the entire agreement. If a term is unenforceable, the rest stands. We may update this Agreement with notice; continuing to receive jobs after the effective date is acceptance.
